Singapore Airlines Delay Compensation Rules: What Rights Do Passengers Have Under SIA Policy?

With the long delay in Singapore Airlines, passengers are left with much to ponder about their right to meals, accommodation, rebooking or even financial compensation. The answer varies depending on the reasons for the delay and the origin and destination of the flight and the consequences thereof.

Your meals, accommodation, travel and rebooking needs will be covered by SIA’s Customer Service Plan during a disruption and statutory protection may cover eligible routes.

What Does Singapore Airlines Provide During a Delay?

If SIA cancels, delays, or diverts a flight, SIA will do its best to minimize inconveniences, including providing meals, transportation to accommodation, and rebooking help, as required by its Customer Service Plan. But any disruption due to circumstances beyond its control could impact on these promises, it says, but it will try to help “where possible.”

Passengers who have less plans for a night’s sleep when there is a disruption such as an overnight one, should therefore discuss accommodation plans with the SIA service desk before making their own arrangements. Travelers should hold traveler reimbursement itemized receipts in the event the airline is unable to facilitate care and where legally possible to the benefit of the passenger.

Rebooking or Refund After a Major Delay

Passengers should enquire at SIA regarding rebooking and refunds if they need to change their travel arrangements for major disruptions, in accordance with the type of fare they have purchased and the Conditions of Carriage and rather than going out and directly addressing the issue with the airline.

The right of entitlement will depend on the itinerary, the conditions of the ticket and the cause of the disruption. If UK261 is relevant, then if it takes more than five hours then the passenger should be able to decide against travelling and receive a refund.

When Can Passengers Claim Cash Compensation?

Owing to the nature of the situation, not all SIA flights delayed will result in automatic cash compensation. That’s mostly dependent on which jurisdiction it’s applicable and the length of time the final destination and how the journey was disrupted.

If it is not the fault of ‘extraordinary circumstances’, passengers can be paid a fixed amount at the airport when flights within the UK261 are more than three hours late. The amount is variable depending on both flight distance and conditions of the delay.

Significantly, technical issues are typically not extraordinary circumstances under UK passenger-rights law, unless they’re serious and major. Sagacious courts and aviation authorities have separated ordinary mechanical failures from extraordinary incidents like sabotage or bullous hiding.

How to Claim Compensation?

Retain your boarding pass, booking reference, delay notification and receipts. Request a written statement of the disruptions and reason (if applicable) for the delay from SIA.

Make the claim via the relevant airline customer-service or claim form. Where a claim under either the UK/EU261 framework is rejected, there’s an ability to appeal to the appropriate dispute-resolution and enforcement proceedings.

FAQs

Does Singapore Airlines compensate all of its passengers with delay?

No. Cash payments are based on the passenger-rights law (law) in effect and on the reason and/or duration of the delay.

What if the technical fault is a failure?

Typically ordinary technical fault is not a sufficient factor for an exception to be available for routes served by UK261, and can help their compensation claim if they meet other prerequisites.

Are you willing to have an overnight delay with SIA?

Under customers Services’ plans, SIA will be expected to, up to the best of its ability, to provide the accommodation and transport for the customer in the event of the delays or misconnections that qualify for accommodation.
