It’s a common misconception that expatriates or global professionals with a legal visa and a signed employment contract may take up any job in the Land of Smiles. But the legal landscape is rather strictly controlled. The Thailand government recently implemented new regulations on foreign workers, which impose strict legal limits on the use of foreign workers.
Even with an existing work permit for a company, it is possible for the activity to be classified as one of the restricted industries and lead to the cancellation of that permit, hefty fines, and deportation. If you want to ensure the security of your employment profile, you need to know about these high-risk areas. All of these 10 jobs are still forbidden for foreigners in Thailand.
Why Thailand Protects Specific Occupations
Expatriate working is regulated by the law based on the Emergency Decree on Foreigners’ Working Management. These are managed directly by Thailand’s Department of Employment (DOE) and guarantee that high-demand service sectors, traditional trades, and cultural crafts are kept for the Thai people only.
Police are to step up their nationwide inspections, according to a recent regulatory update published by the Asia News Network. Should the foreigner’s daily on-the-ground activities be inconsistent with his/her job description, as approved by the business operator, the penalties are very harsh under the statutes.
The 10 Prohibited Jobs in Thailand for Foreigners
If you are planning to work, consult, or launch a business entity, ensure your operational duties completely avoid these restricted occupations for foreigners:
1. Driving Motor Vehicles
Foreigners are NOT allowed to run commercial transport. This involves operating passenger taxis, public vans, tour buses, delivery vehicles or iconic three-wheeled tuk-tuks. The only exception in this category is if it is operated in a private warehouse or factory.
2. Tour Guide or Sightseeing Conductor
Direct or local tour guide services to conduct sightseeing tours are heavily protected. Your local tour packages need to have Thai tour guides who are licensed.
3. Beauty Services, Hairdressing, and Nail Work
Grooming, period! Foreign nationals are not permitted to work as a barber, hair stylist, nail technician, or make-up artist.
4. Traditional Thai Massage
Traditional Thai massage and spa treatments are jealously guarded and considered an essential part of the culture and knowledge of the nation. To open a wellness corporation as an investor, you can’t do the massages yourself.
5. Peddling and Street Vending
Thai nationals are the only people who can operate hawker stalls, push street carts, sell at local fresh markets, or sell lottery tickets on foot.
6. Legal Services and Litigation
It is not possible to act as a lawyer, legal advisor, or represent clients in Thai judicial proceedings. Foreigners may not practise Thai law, except in certain specialised roles in international commercial arbitration.
7. Accounting, Auditing, and Bookkeeping
Local CPAs must be Thai citizens to provide public accounting services, to calculate corporate balance sheets, or to do independent financial audits. Sometimes, cross-border internal auditing by the corporation is allowed.
8. Brokerage or Agency Work
It is illegal to be an independent real estate agent, insurance broker, or stock representative. The limitation is not to apply in cases where the brokerage or agency business is a purely international trade or cross-border investment business.
9. Hand-Woven Cloth and Silk Production
Traditional textile processing, such as reeling the fabric, hand weaving cotton and twisting silk threads by hand, is designated as a protected cultural heritage craft.
10. Cultural Crafts (Wood Carving, Goldware, and Silverware)
Traditional crafts such as making traditional folk art, wood carving, making gold or silver ornaments, bronze casting, making lacquerware, and making traditional Thai dolls are totally closed to foreign workers.
The Price of Non-Compliance: Fines and Deportation
The new foreign worker rules in Thailand have zero tolerance for both parties:
- Foreign Worker: If they participate in such limited jobs in Thailand for foreigners without a permit, they’ll be immediately arrested by the administration, fined between THB 5,000 and THB 50,000, deported, and banned from applying for a work permit for two years.
- The Thai Employer: Businesses that allow foreigners to work beyond their legal scope will be fined between THB 10,000 and THB 100,000 per employee. A ban on foreign labour for three years, a doubling of fines, and up to one year in prison are meted out to repeat offenders.
FAQs
Can I work as a consultant if my job involves real estate?
Using a vague job title like “business consultant” does not bypass the law. If your daily actions involve hands-on real estate brokerage, property showings, or signing domestic contracts, immigration officials will classify it as prohibited agency work during an audit.
Are foreign teachers affected by these prohibited categories?
No. Educational instruction is not on the list of 10 prohibited jobs in Thailand. Qualified expats can legally teach in schools and universities, provided they clear the minimum salary thresholds and secure a license from the Teachers’ Council of Thailand.
What should I do if my work permit description is too broad?
You should coordinate with your corporate HR department or legal counsel to review your work permit annex. Ensure the listed duties describe executive, managerial, or specialized technical roles rather than hands-on labor or localized services.
